The President and Board of Directors of Ugbajo Itsekiri USA hereby inform members of the Association and the general public of recent events pertaining to the Association which has since resulted in litigation and currently awaiting hearing in the Superior Court of the District of Columbia-Civil Division.


In preamble, on or about January, 2021, some disgruntled members of the association held a sham virtual election in which they allocated positions to themselves without following due process and contrary to the constitution and bye-laws of Ugbajo Itsekiri USA.  This brazen act did not stop with the illegal elections but these renegades subsequently paraded themselves as officers of the Association and went on to steal the sum of One Hundred and Fifty Seven Thousand Dollars ($157,000) from the Bank of America account of Ugbajo Itsekiri USA- money which remains unaccounted for to this day.


To date, the renegade group have done everything possible to sabotage our association causing immeasurable damage including  taking legal action to prevent -the recently concluded  and very successful- annual conference in Dallas from taking place; circulating highly flammable, slanderous and scandalous  lies against the previous past President, Mr. Kingsley Onuwaje and furthermore,  filing a frivolous law suit against  Mr. Onuwaje as President of the association in their desperation to tarnish his name. 


That we have shown restraint despite the levels of provocation and the theft of Ugbajo Itsekiri USA funds is not a sign of weakness but our belief in settling these issues in house and as a mark of respect for Ogiame Atuwatse III. But circumstances have forced us to respond to the aforementioned suit filed by this group and   as such, Ugbajo Itsekiri USA is countersuing the following parties: Toju Etchie, Oti Nwosu, Felix Asagba, Ogbemi Omatete, Mac E-Nunu, Eyisan Omagbemi with Bank of America as Co-defendants under the following counts:
COUNT 1- FRAUD & DECEIT
COUNT 2- UNJUST ENRICHMENT
COUNT 3 - CONSTRUCTIVE FRAUD
COUNT 4 - ACCOUNTING FRAUD
COUNT 5 – BREACH OF FIDUCIARY DUTY
COUNT 6 – TORTIOUS INTERFERENCE WITH CONTRACTUAL RELATIONS
COUNT 7 – CIVIL CONSPIRACY
COUNT 8 – DECLARATORY ACTION


Ugbajo Itsekiri USA is not only seeking the return of the One Hundred and Fifty Seven Thousand Dollars ($157,000) but in addition, we are also seeking compensatory damages, consequential damages and Five Hundred Thousand ($500,000.00) in punitive damages, plus interest, attorneys’ fees, the cost of this action, and any and all other relief the court may deem fit. 


We will not comment any further on this issue as the matter is currently subjudice.  But we would like to thank all members of Ugbajo Itsekiri USA and all our well-wishers for their support and encouragement through these very difficult and challenging times.  We have no doubt whatsoever that justice shall prevail.
